Earlier today, the Governor unveiled a new Data Center Accountability Framework and signed Executive Order 22, which directs the immediate implementation of several elements of the framework. The framework also outlines proposed legislation for consideration during the 2027 General Assembly session, which begins January 13, 2027.

A few key takeaways for our technology community:

  • New requirements for data center development: The framework calls for greater state and local oversight of new projects, including changes to permitting and approval processes for larger data centers.
  • Energy and infrastructure costs: The Administration is directing state officials to pursue policies intended to ensure data centers and other large-load customers bear an appropriate share of transmission and generation costs rather than shifting those costs to residential and other customers.
  • New environmental standards: State agencies are being directed to develop or strengthen standards related to water use, noise, emissions, land use, and on-site energy generation.
  • Greater transparency and community engagement: The framework includes new transparency measures and tools to give local governments and communities a greater role in data center development decisions.
  • Workforce and Virginia investment: The framework emphasizes local hiring, workforce development, quality jobs, and greater use of Virginia businesses in procurement and contracting.
  • New Virginia AI Task Force: Executive Order 22 also creates an AI Task Force focused on issues including workforce displacement, data privacy, and cybersecurity.

Given the importance of data centers, energy infrastructure, and artificial intelligence to Northern Virginia’s technology ecosystem and economy, NVTC is reviewing the framework to better understand the potential implications.
