This year’s session was one of the most active in recent history, with more than 3,600 bills introduced and over 2,300 passed to the Governor. As the legislative process for 2026 comes to a close, Virginia’s policy landscape is beginning to take shape.

Biennial Budget Passes 

After more than three months of negotiations, Virginia lawmakers reached a budget compromise that passed on June 22, ending the longest budget impasse in recent Commonwealth history. At the center of the debate was a Senate proposal to end the Data Center Retail Sales and Use Tax exemption eight years early. The final compromise preserves the exemption but creates a new tax of 1.1 cents per kilowatt-hour on electricity consumed by data centers. The tax is expected to generate approximately $1.2 billion for Virginia’s General Fund over the next two years.
