Recent Trends in Patent Office Litigation before the Patent Trial and Appeal BoardJoin the NVTC Tech Law and Procurement Committee for a presentation followed by a panel discussion on recent trends in patent litigation before the Patent Office's Patent Trial and Appeal Board (PTAB). The passage of the America Invents Act in 2011 ushered in a new era of patent litigation, allowing litigants to bring disputes over patent validity back to the Patent Office. These AIA proceedings include inter partes review (IPR), post-grant review (PGR), and covered business method (CBM) proceedings.
Although one early commentator likened PTAB panels to patent "death squads," recent trends show an increasing rate of success for patent owners. Experts will discuss the latest statistics on institution rates, patent confirmation rates, and likelihood of litigation stays. Also up for discussion are hot topics, including identification of the real party in interest and its consequences, the definition of a covered business method, filing of PTAB proceedings by short sellers and other non-traditional patent challengers, trends in Federal Circuit appeals, and how additional patent reform proposals might affect patent litigation and PTAB practice.
