Assembly Passes Transportation Package,
NoVa Self–Help Provisions to Raise

On February 24, the General Assembly approved a statewide transportation funding bill that includes a Northern Virginia self-help component to provide more than $400 million per year in new, dedicated, sustainable transportation funds for the region, meeting the criteria advocated by NVTC and the 21 other business groups comprising the Northern Virginia Business Transportation Coalition.

Assembly Passes Transportation Package, NoVa Self–Help Provisions Raise
$400 Million+ Per Year

Ongoing Discussions to Continue Through April 4 Veto Session

The General Assembly last Saturday approved a statewide transportation funding bill that includes a Northern Virginia self-help component to provide more than $400 million per year in new, dedicated, sustainable transportation funds for the region, meeting the criteria advocated by NVTC and the 21 other business groups comprising the Northern Virginia Business Transportation Coalition (NVBTC). Delegates Dave Albo (R-Springfield) and Tom Rust (R-Herndon) and Senator Jeannemarie Devolites Davis (R-Fairfax) spent the past 18 months leading the regional effort and working with Northern Virginia political and business leaders to craft the self-help package, while also working with their legislative colleagues across the state to build support. The package will ensure that additional money raised in Northern Virginia will be spent on transportation projects in the region.

"We now have in place the major points for a robust regional self-help package advanced by NVTC and our Northern Virginia business coalition partners," said NVTC President & CEO Bobbie Kilberg. "We are gratified that Governor Tim Kaine, Speaker Bill Howell (R-Fredericksburg), President pro tempore John Chichester (R-Northumberland) and leaders of both parties in the House and Senate all demonstrated a strong commitment to addressing our transportation funding crisis this year. We understand that disagreements remain and that the process is an ongoing one and we are hopeful consensus will emerge sometime between now and the conclusion of the Veto Session on April 4."

House Bill (HB) 3202, sponsored by Speaker Bill Howell, would provide approximately $600 million per year in additional statewide transportation funding, a portion of which would be used to support $2.5 billion in transportation bonds. The legislation also would provide for self-help for Virginia's two most congested regions by authorizing local governments in Northern Virginia and Hampton Roads to raise additional funds for local transportation projects.

The Northern Virginia self-help package would be funded through the following local option fees:
  • 2 percent rental car impact fee
  • $0.25/$100 commercial real estate assessment
  • $100 initial driver's license fee (excludes teens)
  • $0.40/$100 congestion relief fee on real estate sales
  • 2 percent transient occupancy tax
HB 3202 is the result of a compromise between Republican leaders in the House and Senate. It was drafted late last week by a 12-member conference committee appointed by the House and Senate to work on a final transportation funding package after both houses rejected their respective transportation proposals two weeks ago. Members of the conference committee included Senator Devolites Davis and Delegate Tim Hugo (R-Fairfax) from Northern Virginia, as well as Delegates Morgan Griffith (R-Salem), Kirk Cox (R-Colonial Heights), Chris Jones (R-Suffolk), Terry Kilgore (R-Scott) and Algie Howell Jr. (D-Norfolk) and Senators Marty Williams (R-Newport News), Tommy Norment (R-James City), Phillip Puckett (D-Russell), Ken Stolle (R-Virginia Beach) and Frank Wagner (R-Virginia Beach).

The General Assembly approved the legislation on Saturday, the final day of the session, with a 64-34 vote in the House of Delegates and a much narrower 21-19 vote in the Senate. The legislation now goes to Governor Kaine who has expressed concerns with the legislation in its current form, including its reliance on state General Fund money, local government action in Northern Virginia and Hampton Roads to raise revenues, and transfer of some road responsibility from state government to local governments.

The statewide package would be funded through
  • one-time allocation from the state's General Fund ($500 million)
  • portion of state recordation taxes reallocated from the General Fund to support transportation bonds ($172 million/year)
  • dedication of 50 percent of all future General Fund surpluses to fund transportation ($64 million/year)
  • dedication of one-third of insurance proceeds to the Transportation Trust Fund ($109-$180 million/year)
  • $10 increase in the motor vehicle registration fee ($62.4 million)
  • new abusive driver fees ($108 million/year)
  • new heavy truck registration fee ($31-36 million/year)

The transportation package remains a work in progress and transportation funding discussions will continue through the April 4 Veto Session as Governor Kaine, legislative leaders, local government officials, business leaders and others review the legislation and propose changes and adjustments.

Results of 2007 Regular Session of the General Assembly

While transportation funding issues overshadowed much of the activity during the 46-day session, the legislature considered more than 3,000 bills and resolutions. The Division of Legislative Services published a comprehensive "2007 Session Highlights" document, which provides a good summary of many of the bills that passed and failed.

Throughout the legislative session, the NVTC lobbying team maintained a full time presence in the state capital where they met with policymakers, testified regarding bills, promoted NVTC's legislative agenda and served as the voice of the technology community of Northern Virginia.

All told, more than 900 bills were sent to the governor’s desk and he has until midnight on March 26 to act on the proposed legislation. The governor may choose to sign legislation, veto legislation or recommend amendments for General Assembly consideration. The General Assembly is scheduled to meet on April 4 for a one-day Reconvened Session or "Veto Session" during which they will consider the governor’s actions and recommendations.

Governor Tim Kaine will discuss his policy initiatives and the results of the General Assembly session at the March meeting of the NVTC Board of Directors prior to the upcoming Veto Session.

Among the bills heading to the Governor’s desk are

Community College Transfer Grant Program Senate Bill (SB) 749 and House Bill (HB) 1681 would establish the Community College Transfer Grant Program to provide higher education grants to community college students who have earned an associate's degree and been admitted to a Virginia accredited, four-year college or university. The grant would be available for eligible students for up to three academic years and is fixed at $1,000 per year with an additional $1,000 per year available for students pursuing undergraduate work in engineering, mathematics, nursing, teaching or science. Funding for this initiative is $1.8 million per year.

SB 749 was sponsored by Walter Stosch (R-Glen Allen); HB 1681 was sponsored by Delegate Vince Callahan (R-McLean), with companion legislation introduced by Delegates Clay Athey (R-Front Royal), Chuck Caputo (D-Chantilly), Ben Cline (R-Amherst), Jeff Frederick (R-Woodbridge), Brian Moran (D-Alexandria) and Mark Sickles (D-Alexandria).

Competitiveness in Attracting and Retaining Faculty Since the ability for Virginia colleges and universities to effectively respond to an increasingly competitive market for high quality faculty has diminished over the years, Delegate David Nutter (R- Christiansburg) introduced House Joint Resolution (HJ) 642 to study Virginia's competitiveness in attracting and retaining faculty for public institutions of higher education.

Computer Crimes - Spyware HB 2353 would amend the Commonwealth's existing computer trespass statute by adding keyboard loggers and bots and zombies to the list of computer trespass crimes and would make it a Class 6 felony for a person to install or collect information through software capable of recording all or a majority of the keystrokes on the computer of another. The legislation was recommended by the Joint Commission on Technology and Science’s (JCOTS) Cybercrimes Working Group on which several NVTC members participated. The bill sponsor was Delegate John Cosgrove (R-Chesapeake).

Electronic Health Records HB 2198, a product of the JCOTS Subcommittee on Electronic Medical Records on which several NVTC members served, would require any electronic health records system or software purchased by a state agency to adhere to accepted standards for interoperability. The bill was sponsored by Delegate Sam Nixon (R-Chesterfield).

Modeling and Simulation Advisory Council HB 2030, sponsored by Delegate John Cosgrove (R-Chesapeake), would create the Modeling and Simulation Advisory Council to advise the governor on policy and funding priorities to promote the modeling and simulation industry in the Commonwealth and to assist in making Virginia a national leader in this growing industry.

Nanotechnology Users NetworkHJ 647 would establish a Nanotechnology Users Network at Virginia institutions of higher learning. The JCOTS Nanotechnology Advisory Committee, on which several NVTC members served, advocated for the development of this network because it would improve collaboration among universities in the field of nanotechnology and as essential element to providing a skilled workforce for Virginia's growing technology industry. This legislation was carried by Delegate Bob Purkey (R-Virginia Beach).

One-Stop Permitting for Small Businesses As reported in previous editions of The NVTC Advocate, HB 3164 would streamline and consolidate the business registration and permitting process for entrepreneurs in Virginia. The bill would leverage technology to provide Virginia entrepreneurs with a single access point to fill out and submit the various permit applications associated with establishing a small business in Virginia. NVTC has been a strong supporter of this legislation because it would keep Virginia competitive as a preferred place to start a business and help entrepreneurs reduce their transaction costs with government so they can instead focus on hiring talented employees, bringing their products to market and growing their bottom lines. Delegate Brian Moran (D-Alexandria) sponsored HB 3164.

Science and Technology Education Delegate Bob Purkey (R-Virginia Beach) has been a strong, consistent advocate for improved science and technology learning at all levels of education. This legislative session, he sponsored HJ 611 that would establish a joint subcommittee to study science and technology education in business, law and policy graduate programs in state institutions of higher education and to determine possible ways to provide incentives for students to pursue careers in these sectors.

Telework SB 1004 would authorize state agencies to allow employees to use personal computers to telecommute as long as the equipment is not used to access or store records or data that contain information considered confidential by federal or state law. Senator Jeannemarie Devolites Davis (R-Fairfax) was the sponsor of the bill.

Wireless Broadband HB 2385 would allow local governments to apply a lower personal property tax rate for property owned by wireless broadband Internet service providers used to provide these services to customers. Delegate Joe May (R-Leesburg) sponsored the bill. He also sponsored HB 2381 that would specify that Virginia may enter into public-private partnerships to provide the technology and infrastructure necessary to deploy wireless broadband services to schools, businesses and residential areas.

Youth Internet Safety Fund HB 3017 would create the Youth Internet Safety Fund to educate, increase public awareness and provide for additional activities to promote safe and secure use of the Internet. The Fund would permit an ongoing public education and awareness program for parents and children through television, radio and DVDs and other promotional materials. Virginia companies and organizations would have the opportunity to contribute to this fund, as would the General Assembly. The bill was prompted by the recommendations of Virginia Attorney General Bob McDonnell’s Youth Internet Safety Task Force. The task force consisted of a law enforcement working group, a parents and educators working group and a technology partners working group, which included NVTC President & CEO Bobbie Kilberg and NVTC member company representatives from AOL, Microsoft and Capital One. HB 3017 was carried by Delegate Vince Callahan (R-McLean).

General Assembly Unanimously Adopts Budget Bill

Before adjourning, the General Assembly unanimously adopted the budget bill (House Bill 1650), which would amend Virginia’s 2006-2008 biennial budget. Governor Tim Kaine has until midnight on March 26 to review the budget at which point he may sign it, veto the entire bill, veto specific line items or recommend his own amendments. The General Assembly will hold its reconvened session or “veto session” on April 4 during which the legislative body will consider the governor’s legislative actions.

George Mason University

While the budget introduced by the governor would have provided George Mason University (GMU) with an additional $4.38 million in funds to allow for enrollment growth and base adequacy, the General Assembly only provided GMU with an additional $1.27 million towards enrollment growth and base adequacy and $614,000 as a tuition moderation incentive if GMU does not increase tuition and fees by more than 6 percent. The budget approved by the General Assembly also provides GMU with $100,000 for a Housing Policy Research Center, boosts the governor’s recommended 3 percent faculty salary increase to 4 percent and provides the full $1.4 million in need-based student financial assistance recommended by the governor.

Northern Virginia Community College

The General Assembly would provide the Northern Virginia Community College (NVCC) with funding for the $23.4 million technology building in Manassas that would give NVCC 55,000 square feet of lab and classroom space to accommodate student growth in the region. The capital investment would be financed through bonds. While the governor recommended the Virginia Community College System (VCCS) receive $4.5 million in enrollment growth and base adequacy funding, the General Assembly instead funded these items at $2.1 million with an additional $1 million available as a tuition moderation incentive if VCCS tuition and fees do not exceed 6 percent. The General Assembly also approved the governor’s recommendation to provide VCCS with $3.49 million in financial aid and boosted faculty salary increases from 3 percent to 4 percent.

CIT

The General Assembly and the governor retained current funding levels for CIT at $6.2 million, although the General Assembly would allocate an additional $75,000 in funding to study the potential for establishing a National Center for the Sensor Sciences in the Hampton Roads region in partnership with federal agencies, higher educational institutions and the private sector.

Research

The General Assembly assigned an additional $6 million for research initiatives, including

  • $2 million for cancer research at the University of Virginia and Virginia Commonwealth University.
  • $1.5 million for the Virginia Coastal Energy Research Consortium, which seeks to identify and develops new coastal energy resources through multidisciplinary research collaborations and environmentally responsible strategies.
  • $1 million for the Thomas Jefferson National Accelerator Facility (Jefferson Lab), whose primary mission is to conduct basic research of the atom's nucleus at the quark level and which has a derivative mission with industry and derivative partners to do applied research on use of the free-electron lasers based on technology the laboratory developed to conduct its physics experiments.
  • $1 million for the Commonwealth Technology Research Fund. The Fund, administered by CIT, focuses on strategic enhancement, matching funds, industry inducement and the commercialization of technologies to attract public and private research funding for institutions of higher education to further technological and economic development in Virginia.

The budget also would provide $12 million in state incentive funds for SRI International to assist in establishing a new Center for Advanced Drug Research in the Shenandoah Valley. The total state commitment is $22 million. SRI International plans to add other high technology programs in areas such as homeland security, engineering, nanotechnology, energy, information technology and education at its new site and will partner with James Madison University and other Virginia institutions in its research efforts. Technology Transportation Initiative

The General Assembly chose not to approve funding for Governor Kaine's $20-million technology innovation grant initiative to offer incentives for ideas that reduce congestion or increase transportation options in Northern Virginia and Hampton Roads through highway and transit demand management and consumer technologies. NVTC supported this initiative because leveraging private sector, technology-based transportation solutions is a critical step to relieving traffic congestion and would provide Northern Virginia commuters with more information, choice, predictability and safety. Legislators had concerns about the proposal, particularly regarding the lack of specificity on how the new funds would be administered and utilized.

Broadband

The General Assembly approved the governor’s $1.6-million universal broadband initiative.

Belmont Bay Science Museum

The budget includes $5 million to support the Belmont Bay Science Museum in Prince William County.
