Transportation Remains Center Stage, NVTC Efforts Continue

With only two weeks remaining in the legislative session, transportation funding continues to dominate legislative efforts. While House and Senate members of both parties recognize the urgency of tackling Virginia's transportation funding crisis and agree on some common components and principles, consensus on transportation funding remains elusive. The only remaining bill at this point is one endorsed by the House but previously rejected by the Senate. A growing number of legislators are urging Governor Timothy M. Kaine to introduce a new compromise bill in an effort to broker a deal both House and Senate members can support.

House Approves Transportation Proposal, Senate to Reconsider

The House of Delegates adopted House Bill 3202, a joint proposal of leading House and Senate Republicans introduced several weeks ago. The legislation, sponsored by Speaker Bill Howell (R-Fredericksburg), provides (i) statewide funding of transportation projects through current funds, new fees and a tax increase on diesel fuel, (ii) authority to localities in Northern Virginia and Hampton Roads to impose additional fees and taxes for transportation, and (iii) several administrative and efficiency reforms impacting transportation. The bill also authorizes the issuance of $2 billion in bonds for statewide transportation funding in $300 million annual increments. This is the only transportation funding bill that passed the House.

The Senate defeated its version of this legislation last week, because of concerns that the plan relied on annual appropriations of $250 million in General Fund money rather than new revenue streams. General Fund money traditionally has supported education, health care, public safety and similar state expenditures, while transportation has relied on dedicated sources of revenue, such as the gasoline tax and a portion of the sales tax. Some legislators expressed strong concerns about having transportation compete for General Fund money. Others prefer not to increase taxes or fees to fund transportation.

The Senate Finance Committee had proposed an alternative transportation plan which would have imposed the 5 percent sales tax on gasoline to raise revenues rather than relying on the General Fund. But Senate germaneness rules and growing divisiveness within the Senate led senators to send that proposal back to Committee where it died. As a result, the Senate did not approve a transportation proposal to send to the House and the House bill is the only one left standing. Now the Senate will consider HB 3202.

Meanwhile, a growing number of legislators are urging Governor Timothy M. Kaine to introduce a new compromise bill in an effort to broker a deal both House and Senate members can support. In Virginia, the Governor may introduce a bill at any time during the session.

Transportation funding to adequately address the crisis in our area is a critical NVTC priority. NVTC is actively working the transportation funding issue through the Northern Virginia Business Transportation Coalition, which includes the Greater Washington Board of Trade, the Northern Virginia Association of Realtors, the Northern Virginia Building Industry Association, the Northern Virginia Transportation Alliance, most local and regional chambers of commerce, and other powerful groups. The Coalition continues to call on General Assembly members to unify behind a transportation funding plan that is broad-based and includes a minimum of $400 million per year in new, dedicated, sustainable transportation funds for Northern Virginia.

In addition to staff efforts, NVTC Board members and other technology executives are visiting regularly with policymakers to underscore the severity of Northern Virginia's transportation crisis and insist that legislators enact a substantial funding solution this year.

Legislation Would Create One-Stop Permitting for Small Businesses

The House this week approved legislation to streamline and consolidate the business registration and permitting process in Virginia. House Bill 3164, introduced by Delegate Brian Moran (D-Alexandria), would leverage technology to provide Virginia entrepreneurs with a single access point to fill out and submit the various permit applications associated with establishing a small business in Virginia.

NVTC is a strong supporter of this legislation because it would keep Virginia competitive as a preferred place to start a business and help entrepreneurs reduce their transaction costs with government so they can instead focus on hiring talented employees, bringing their products to market, and growing their bottom lines.

House and Senate Adopt Competing Budget Bills

The House and Senate each adopted their respective budgets proposal yesterday. The House and Senate each will reject the other body's proposal early next week at which point each body will appoint budget conferees to work out the significant differences between the two proposals.

George Mason University

The Senate approved the Governor's budget amendments providing for $2.4 million in additional base adequacy funding for George Mason University to address Virginia's commitment to quality in education.

The House of Delegates, however, removed the base adequacy funding for GMU and Virginia's other higher educational institutions and also $384,000 of the $1.4 million in student financial assistance the Governor proposed for GMU. The House instead funded a Tuition Moderation Incentive Fund. The Fund would provide GMU with $3.2 million in additional funding next year provided tuition and fee increases do not exceed 6.5 percent.

While the Governor and the Senate proposed a 3 percent salary increase for faculty and graduate assistants, the House is proposing a 4 percent increase.

Northern Virginia Community College

The House proposal provides the Northern Virginia Community College with funding for the $29.15 million Academic Building in Manassas to provide NVCC with 55,000 square feet of desperately needed lab and classroom space to accommodate student growth in the region. The capital investment would be financed through bonds.

The Senate did not provide funding in their proposal.

The House of Delegates removed the $4.5 million in base adequacy funding and $850,000 in student financial assistance the Governor proposed for the Virginia Community College System. The House instead funded a Tuition Moderation Incentive Fund. The Fund would provide the Community College System with $6 million in additional funding next year provided tuition and fee increases do not exceed 4.75 percent. The Northern Virginia Community College is one of 23 colleges that comprise the Virginia Community College System.

The Senate approved the Governor's budget proposals and provided an additional $1.5 million for faculty salaries.

Center for Innovative Technology

NVTC is pleased to note that both proposals retain current funding levels for The Center for Innovative Technology at $6.2 million although the Senate does provide an additional $75,000 in CIT funding for a National Center for Sensor Sciences.

Research

The House and the Senate each added an additional $1 million to the Governor's $2.5 million budget proposal for research.

The Senate research proposal includes additional funding for the Virginia Coastal Energy Research Consortium and upgrades at the Thomas Jefferson National Accelerator Facility.

The House proposal includes additional funding for the Virginia Coastal Energy Research Consortium and also cancer research at the University of Virginia.

Technology Transportation Initiative

Unfortunately, both the House and the Senate eliminated funding for Governor Timothy M. Kaine's $20 million technology innovation grant initiative to provide incentives for ideas that reduce congestion or increase transportation options in Northern Virginia and Hampton Roads through highway and transit demand management and consumer technologies. NVTC supported this initiative believing that the leveraging of private sector, technology-based transportation solutions is a critical step to relieve traffic congestion and to provide Northern Virginia commuters with more information, choice, predictability, and safety. While there is support in the General Assembly for transportation technology, legislators had concerns about the proposal including the lack of specificity regarding how the new funds would be administered and utilized.

NVTC is still in the process of digesting the House and Senate budget proposals to determine their specific impact on NVTC priorities. Stay tuned!

Telework Tax Credit Bill Stalls in Senate

The Senate Finance Committee this week chose not to approve legislation sponsored by Senator Mark Herring (D-Loudoun) which would have created a state telework tax credit program. While there was little discussion among Committee members regarding the legislation, the Senate has traditionally disfavored tax credits as an incentive mechanism.

The legislation, supported by NVTC, the Greater Richmond Technology Council, and the Hampton Roads Technology Council, would have created individual and corporate income tax credits for employers that incur eligible telework expenses of up to $1,200 per employee. State estimates indicated as many as 4,000 new teleworkers per year would have qualified for the tax credits. An identical measure introduced by Delegate Jeff Frederick (R-Woodbridge) was killed in the House Finance Committee earlier in the session.

NVTC is a long-term, vocal proponent of telework because it benefits the public and makes good business sense. NVTC will continue efforts to expand the use of telework throughout Virginia because telework:
  • helps to reduce traffic congestion on our region's clogged transportation arteries;
  • is good for the environment;
  • helps companies attract a talented workforce because it offers flexibility and is "family-friendly;"
  • enables the smartest people around the world to work for companies in Northern Virginia;
  • positively impacts companies' bottom lines by cutting space requirements and other related expenses; and,
  • provides necessary operational continuity in the event of a catastrophe.
Earlier NVTC actions in Richmond helped lead to the creation of a telework program for state employees, Governor Kaine's launch of the Office of Telework Promotion and Broadband Assistance earlier this year, and the establishment of a legislative subcommittee to study ways in which telework opportunities can be enhanced and increased.

During a telework event with Governor Kaine and Secretary of Technology Aneesh Chopra in November 2006, NVTC and The Telework Coalition (TelCoa) unveiled a pledge signed by 32 Northern Virginia technology companies supporting efforts to "expand or implement telework within our organizations and to encourage our colleagues in other organizations, private and public, to implement or expand telework."

Community College Transfer Grants Endorsed by House and Senate
Funding and Scope of Eligibility Differ


Legislation establishing the Community College Transfer Grant Program in Virginia has passed both the House and the Senate but in different forms.

NVTC supports community college transfer grants as an innovative way to meet the Northern Virginia technology community's continuing need for a highly skilled, highly educated workforce.

The Community College Transfer Grant Program encourages Virginia students with financial need to complete a transferable, associate's degree at a community college and then continue their education at a four-year institution in Virginia. The award is intended to offset the difference between the cost of tuition at the community college and the four-year institution.

The House version of this legislation (click here), sponsored by Delegate Vince Callahan (R-McLean), limits eligibility to undergraduate collegiate work in engineering, mathematics, nursing, teaching, or science. The Senate version (click here), sponsored by Senator Walter Stosch (R-Henrico), does not limit eligibility based on course work.

While the Senate Budget proposal provides $1.8 million in funding for this program, the House would defer eligibility (and funding) until next year.
