Senate Offshore Outsourcing Bill Defeated 6-8, House Bill to Be Heard Next Week NVTC was successful this week in defeating legislation that would have placed new reporting requirements on state contractors in an effort to discourage the use of offshore employees on state contracts. The NVTC Board of Directors voted during its January meeting to strongly oppose this legislation. The bill was defeated by a close vote of 8-6 following a week of intense lobbying efforts by NVTC. NVTC Chairman Emeritus Sudhakar Shenoy and NVTC Vice President for Policy Josh Levi were joined by Bob Stolle of the Greater Richmond Technology Council in testifying against the bill, which was heard on Wednesday before the Senate General Laws and Technology Committee. The legislation, introduced at the request of organized labor, drew strong support from Democratic members of the Senate Committee with districts outside Northern Virginia and also rural Republican members. NVTC lobbying efforts led to strong, bipartisan opposition from the Northern Virginia legislators on the Committee, with Senators Chuck Colgan (D-Manassas), Jeannemarie Devolites Davis (R-Fairfax), Mark Herring (D-Loudoun), and Jay O'Brien (R-Clifton) banding together to help defeat the bill. Senators Devolites Davis and O'Brien were particularly vocal in discussing their shared concern that this legislation would harm Virginia technology businesses that have supply chains, subcontractors, strategic partners, labor pools, and customers located throughout the world. In response to NVTC concerns, the bill was amended at one point to remove its most punitive provisions but still retained the burdensome reporting requirements that would have forced companies to disclose whether employees of contractors or subcontractors were located outside the United States and to report changes in employee locations throughout the life of the contract. NVTC will be testifying against the House version of this bill when it is heard in the House General Laws Committee next Tuesday. To review the letter NVTC sent Governor Kaine last week on this issue, click here. - Back to top - Internet Sales Tax Bill Will Not Move Forward Senator Emmett Hanger (R-Mount Solon) has decided not to move forward with the Internet Streamlined Sales and Use Tax Agreement bill he introduced this year. In announcing his decision to the Senate Finance Committee, Senator Hanger cited technology industry opposition as a primary reason, along with the lack of national consensus on the specifics of the multi-state tax scheme. In 2003 and 2004, NVTC took the lead in opposing this legislation which sought to enlist Virginia technology companies in a multi-state effort to collect sales taxes on Internet and remote sales. At NVTC's urging, the General Assembly did not enact the bill during those sessions and instead created a legislative study panel, which conducted a comprehensive analysis of costs, compliance burdens, benefits, and international competitiveness implications. The General Assembly's Joint Subcommittee to Study the Impact of Collecting Remote Sales Taxes on the Economy of the Commonwealth found no compelling reason for Virginia to adopt the multi-state scheme at that time, citing many unanswered questions about collection costs and the lack of any evidence that the benefits to the state treasury justify the collection costs imposed on Virginia businesses. NVTC continues to have serious concerns about the multi-state Streamlined Sales and Use Tax Agreement. NVTC believes the legislation will burden Virginia technology companies, serve as a barrier to e-commerce, and counter many of the benefits of e-commerce including speed, convenience, accuracy, productivity, and expanded markets. NVTC also is concerned that the legislation would 1) Place Virginia at risk of losing some of its competitive advantage over other states in attracting software companies through favorable tax and regulatory incentives; and 2) Require Virginia service providers to collect the sales taxes for states that tax services even though the services are performed in Virginia by Virginia companies. - Back to top - Nanotechnology Day at the General Assembly
Throughout the day, numerous senators, delegates, and their staff perused the 19 exhibits of nanotechnology companies, federal entities, and universities; stopped by a nanotechnology information table in the lobby of the General Assembly Building; viewed an informative slideshow on Virginia nanotechnology; and acquired a copy of "Nanotechnology in Virginia," a white paper prepared by the JCOTS Nanotechnology Advisory Committee. Regulatory RFID Bill Halted, Sent for Further Study The House Science and Technology Committee chose this week not to move forward with legislation that would have imposed new regulatory restrictions on the use of RFID technology in Virginia. House Bill (HB) 2086, introduced by Delegate Al Eisenberg (D-Arlington) would have required Virginia stores that sell goods containing RFID tags to conspicuously label the goods as such. NVTC lobbyists met with Delegate Eisenberg and members of the House Science and Technology Committee to explain that RFID technologies are increasingly being used to provide greater efficiency and accuracy to a variety of business practices, including the tracking of products, inventory management, loss and theft prevention, identity verification, and anti-counterfeiting measures. NVTC shared with legislators our strong belief that HB 2086 reflects a fundamental misunderstanding of RFID technology, its current uses, and its emerging capabilities. NVTC also noted our concern that passage of this legislation would stigmatize RFID technology and harm NVTC members companies that are leaders in this field. After hearing from NVTC, the retail industry, and individual NVTC member companies, Delegate Eisenberg told the Science and Technology Committee that he thought his bill and the underlying issues needed further study.
